GENERAL TERMS AND CONDITIONS OF THE WEBSITE AND ONLINE STORE 

This document contains the terms and conditions that apply to all orders placed at Mellowstore.ge. You agree with us and accept the terms and conditions by placing your order. The purchase by telephone also implies the acceptance of these Conditions, which he/she recognises to have read beforehand and to have understood and accepted the conditions mentioned above.

Mellow Kids LLC reserves the right to revise and modify the Terms and Conditions at any time. Please be sure to check the privacy policy each time you make a purchase to be aware of your rights.

PAYMENT POLICY

Payment shall be made by Visa, Mastercard. Invoices are due and payable within the agreed time period if the preferred payment method is by invoice. Mellow has all the discretion to cancel or deny orders. Mellow is not responsible for pricing, typographical or other errors, and we reserve the right to cancel any orders arising from such errors.

We accept the following methods of payment: Visa | Mastercard

If an error occurs in the payment process with your credit card, you will immediately receive an email to inform you. In this case, the payment will not be processed, and your order will be put on hold. You will need to contact the e-mail service to determine the action to be taken concerning your order.

Mellow does not have access to the payment page or the bank card data specified by the user. A notification with relevant information will be displayed on the screen if the payment is successful.

Mellow company reserves the right to suspend the processing and delivery in the case of a payment authorisation by bank card being refused by officially accredited organisations or in the case of non-payment. Mellow company notably reserves the right to refuse to process and deliver an order placed by a client who has not paid in total a previous order or with whom a payment dispute still needs to be settled.

After completing the payment procedure, the user receives an e-mail with confirmation that the order was placed successfully.

RISK OF LOSS

All items purchased from Mellow are insured in accordance with the shipping contract. The parcel is declared to be lost if the delay in delivery reaches up to three months. In the case of a lost parcel, our contractor will be notified, and after a series of investigations, if the parcel is still missing, you will be compensated for the full amount of your order. Depending on availability, customers will always have the option to request a replacement.

TERMS AND CONDITIONS OF DELIVERY OF PURCHASED PRODUCTS

LOCAL SHIPPING
The user declares consent “Deliverers” LLC (identification code: 404636710, registered address: Georgia, Tbilisi, N1 Aleksidze Street) to transport the purchased product.

Parties of the delivery agreement are the customer and “Deliverers” LLC.

To ensure a courier service, Mellow transfers customers’ personal data to “Deliverers” LLC. This data include the customer’s name, last name, address and phone number.

Mellow delivers the purchased product to the courier company “Deliverers” LLC, which transports it to the address specified by the customer. Mellow’s responsibility and obligation are fulfilled when the products are handed over to the courier company. From that moment, the product loss and damage risk are fully transferred to the courier service company.

DELIVERY TIME

Customers can receive the purchased product both on working days and Saturdays. In Tbilisi, products purchased before 13:00 will be delivered on the same day. As for the products purchased after 13:00, delivery service will be provided the next day. Products purchase on Saturday after 13:00 or on Sunday, delivery service will be provided from Monday unless costumer and Mellow agreed on other delivery options. Please, keep in mind that delays may occur for reasons such as the customisation of products, the occurrence of unforeseen circumstances or the delivery zone.

The buyer covers delivery service.

Purchased items can be collected from Mellow physical store. A person needs to have some proof of identity, as well as an invoice for the order he/she wants to pick up.

DUTIES AND TAXES

Any Purchase delivered outside of Georgia may be subject to duties and taxes. The law regarding import duties differs from county to country. Taxes and duties are calculated according to your shipping destination and are not included in the final price.

PRICING AND DESCRIPTION

Prices displayed for products on Mellow represent the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice, or the estimated retail value for a comparably featured item offered elsewhere. We do not warrant that this site’s product descriptions or other content are accurate, complete, reliable, current, or error-free. If a product on our website is different from what is described, your sole remedy is to return it unused.

ACKNOWLEDGMENT OF RIGHTS

You hereby acknowledge that all rights, titles and interests, including but not limited to rights, are covered by the Intellectual Property Rights. You will not acquire any right, title, or interest in or to the program expressly set in this agreement. You hereby agree that you will not modify, adapt, translate, prepare derivative works, decompile, reverse engineer, disassemble or attempt to derive source code from any of our services, software, documentation, as well as create or attempt to create a substitute or similar service or product through use of or access to the program or proprietary information related thereto.

FRAUD

Fraudulent Activities are highly monitored on our site, and if fraud is detected, Mellow shall resort to all remedies available to us, and you shall be responsible for all costs and legal fees arising from these fraudulent activities.
NON-WAIVER
Failure of Mellow to comply upon strict performance of any of the terms, conditions, and agreements hereof shall not be deemed as a loss or waiver of any rights or remedy that we may have, nor shall it be interpreted as a waiver of any subsequent breach of terms, conditions or agreements. Hereof, terms, conditions and agreements shall continue to be in full force and effect.

No waiver by either party of any breach of any provision hereof shall be deemed a waiver of any subsequent or prior breach of the same or any other provision.

MISCELLANEOUS

This agreement shall be governed by and construed in accordance with the substantive laws of Georgia without any reference to conflict-of-laws principles.

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Georgia, to the exclusion of any other courts, without giving effect to its conflict of laws provisions or your actual state or country of residence.

The entire agreement between the parties with respect to the subject matter hereof is embodied in this agreement, and no other agreement relative hereto shall bind either party herein.

Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this agreement without liability to us. However, we may assign this agreement to any person at any time without notice.

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

RETURNS AND EXCHANGES

RETURN/EXCHANGE PROCEDURES FOR INTERNATIONAL CUSTOMERS
Customer satisfaction is our top priority. W e do our best to offer high-quality goods and excellent customer service online and offline to meet the expectations of every consumer . It is important to us that you love your selection. If for any reason you are not completely satisfied with your purchase, you can simply return/exchange the item(s).   We are pleased to accept timely returns of item(s)  in unused, unworn, unwashed and undamaged condition. Item(s) must be returned in the original packaging, including tags, boxes and pouches. Please, avoid wearing perfume/deodorant when trying on clothes and contact with perfume/deodorant/water when trying on jewellery as we will not be able to accept the return with the evidence of scent or marks on the item when trying on clothes as we will not be able to accept the return with the evidence of marks or scent on the item(s). Return of tights, socks, hair accessories, earrings, swimsuits, underwear, underwear accessories, and undergarments is impossible due to hygiene reasons!

If your parcel is damaged, you must declare such damage before the courier on arrival. Once returning the parcel item must be declared as a returned item, do not to declare the cost.

Return Policy is an integral part of the Terms and Conditions of using website, thus by agreeing to the Terms and Conditions of using the website, you also agree to the Return Policy given here.

In case you decide to return an item, please, follow the relevant procedures. You can submit your request to return/replace the product in written form. After sending us an e-mail Mellow team will receive your request, and you will be informed about the next steps. Mellow customer is only allowed to return the parcel following the procedure mentioned above. The return costs are the customer’s responsibility, who is free to choose the shipping method.

REFUNDS

Once the returned parcel reaches the warehouse of Mellow, you will receive a confirmation e-mail, and money will be refunded to you (excluding shipping cost) within ten working days after receipt of the parcel; except during the holiday season, return processing may take more time than expected.

PLEASE NOTE: No refunds will be issued for an item returned in a used/damaged condition or without the original tags, pouches and boxes. The parcel is your responsibility until it reaches Mellow. We recommend sending the parcel using a delivery service that insures you for the value of the products. “Sale”/” Special Offer” items are non-returnable or refundable. You may only exchange the sale items.

EXCHANGES
